Terms and Conditions

By purchasing, renting, financing, reserving, servicing, or otherwise conducting business with Valley Trailer Sales & Rentals ("Valley Trailers," "we," "us," or "our"), the customer ("Customer," "Renter," or "Purchaser") agrees to the following terms and conditions.
1. General Agreement
Valley Trailer Sales & Rentals provides trailer sales, trailer rentals, trailer financing assistance, parts, accessories, service referrals, and related products and services.
By completing a transaction with Valley Trailers, the Customer acknowledges that they have read, understood, and accepted these Terms and Conditions.
2. Trailer Rental Requirements
Customers renting equipment must:
Be at least 18 years of age.
Possess a valid driver's license.
Provide proof of insurance if requested.
Present valid government-issued identification.
Provide payment information and security deposit when required.
Valley Trailers reserves the right to refuse rental service at its sole discretion.
3. Rental Inspection
All rental equipment is inspected prior to release.
The Customer agrees to inspect the trailer before leaving the premises and acknowledges that:
The trailer has been received in satisfactory condition.
All lights, brakes (where equipped), safety chains, couplers, tires, and accessories are functioning properly.
Any pre-existing damage has been documented.
Once the trailer leaves Valley Trailers' possession, responsibility transfers to the Customer.
4. Customer Responsibility During Rental
The Customer assumes full responsibility for:
Proper towing practices.
Compliance with all federal, provincial, state, and local laws.
Ensuring their tow vehicle is properly equipped.
Proper cargo securement.
Weight compliance.
Safe operation of the trailer.
Valley Trailers is not responsible for:
Improper loading.
Improper towing.
Cargo loss.
Vehicle damage.
Accidents.
Roadside incidents.
Traffic violations.
5. Damage to Rental Equipment
The Customer is responsible for all damage occurring during the rental period, including but not limited to:
Tire damage.
Wheel damage.
Bent frames.
Bent ramps.
Electrical damage.
Lighting damage.
Coupler damage.
Jack damage.
Structural damage.
Cosmetic damage.
Repair costs may be deducted from any security deposit and billed to the Customer.
If repair costs exceed the deposit amount, the Customer agrees to pay the remaining balance.
6. Theft and Loss
The Customer remains responsible for the trailer until it is returned and accepted by Valley Trailers.
In the event of theft, loss, seizure, impoundment, or total destruction:
The Customer must immediately notify Valley Trailers.
The Customer may be responsible for replacement costs.
Insurance proceeds shall first be applied toward Valley Trailers' losses.
7. Late Returns
Rental equipment must be returned on or before the agreed return date and time.
Late returns may result in:
Additional rental charges.
Administrative fees.
Loss of future rental privileges.
Valley Trailers reserves the right to charge the payment method on file for overdue rentals.
8. Prohibited Uses
Rental equipment may not be used:
For illegal activities.
For transporting hazardous materials unless approved.
For racing or competitive events.
Beyond manufacturer weight ratings.
Outside Canada without written authorization.
By any unauthorized driver.
Violation of these provisions may result in immediate termination of the rental agreement.
9. Trailer Sales
All trailer sales are final unless otherwise stated in writing.
The Purchaser is responsible for:
Inspecting the trailer before acceptance.
Confirming specifications.
Confirming suitability for intended use.
Valley Trailers does not guarantee that any trailer is suitable for a specific purpose unless expressly stated in writing.
10. Deposits and Reservations
Deposits may be required to:
Reserve inventory.
Hold trailers.
Secure special orders.
Unless otherwise stated in writing:
Deposits are non-refundable.
Deposits may be applied toward the purchase price.
Valley Trailers may retain deposits for cancelled orders.
Special-order trailers may not be cancelled once manufacturing has commenced.
11. Financing
Where financing is offered through third-party lenders:
Financing approval is subject to lender requirements.
Valley Trailers does not guarantee approval.
Financing terms are determined solely by the lender.
The Customer authorizes Valley Trailers and financing partners to collect information required for financing applications.
12. Warranty Disclaimer
Manufacturer warranties, where applicable, are provided by the manufacturer.
Valley Trailers makes no additional warranties, express or implied, including:
Merchantability.
Fitness for a particular purpose.
Future performance.
Warranty claims must be submitted according to the manufacturer's procedures.
13. Parts and Accessories
Parts and accessory sales are final unless defective.
Electrical components, custom orders, and special-order items may not be eligible for return.
Returns may be subject to:
Inspection.
Restocking fees.
Manufacturer approval.
14. Limitation of Liability
To the fullest extent permitted by law:
Valley Trailers shall not be liable for:
Indirect damages.
Consequential damages.
Loss of income.
Loss of business.
Cargo damage.
Personal injury resulting from misuse.
Property damage resulting from misuse.
Valley Trailers' total liability shall not exceed the amount paid by the Customer for the transaction giving rise to the claim.
15. Indemnification
The Customer agrees to defend, indemnify, and hold harmless Valley Trailers, its owners, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or legal expenses arising from:
Trailer operation.
Trailer misuse.
Cargo transportation.
Negligent acts of the Customer.
16. Insurance
The Customer is solely responsible for ensuring adequate insurance coverage for:
The tow vehicle.
The trailer.
Cargo being transported.
Valley Trailers does not provide cargo insurance.
17. Roadside Breakdowns
Mechanical breakdowns must be reported immediately.
The Customer shall not authorize repairs exceeding $100 without prior written approval from Valley Trailers.
Unauthorized repairs may not be reimbursed.
18. Website Information
Prices, specifications, inventory availability, photographs, and descriptions displayed on our website may change without notice.
Errors and omissions may occur.
Valley Trailers reserves the right to correct pricing or specification errors at any time.
19. Privacy
Customer information is collected for:
Sales transactions.
Rental agreements.
Financing applications.
Customer service.
Information will be handled in accordance with applicable Canadian privacy laws.
20. Governing Law
These Terms and Conditions shall be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
Any legal action shall be brought exclusively within the courts of British Columbia.
21. Dispute Resolution
Prior to commencing legal action, the parties agree to attempt to resolve disputes through good-faith negotiation.
If resolution cannot be achieved, the parties may agree to mediation before litigation.
22. Acceptance
By purchasing, renting, reserving, financing, or otherwise conducting business with Valley Trailer Sales & Rentals, the Customer acknowledges acceptance of these Terms and Conditions.
